In early October, a 22-member workgroup convened by the Federation of State Medical Boards met privately in Washington to develop recommendations for how states should regulate AI in medicine. Participants include the American Medical Association, the American Hospital Association, AI company Anthropic, and insurer Elevance Health.

The group's focus is on AI tools that perform clinical functions with limited or no direct physician supervision, according to FSMB president and CEO Humayun Chaudhry. The discussions are confidential, but a draft of the recommendations could be released for public feedback within weeks to months.

Because states individually regulate medical licensure and the practice of medicine, the guidelines could eventually be turned into state legislation. The workgroup's sponsor said it was designed to balance expertise across medical regulation, AI development, care delivery, academic medicine, state AI policy, and patient safety.
