In Arizona, a man convicted of manslaughter will be resentenced because an AI-generated video of his victim, speaking from beyond the grave, was ruled to have carried 'undue emotional weight' in court. The appellate court upheld the manslaughter conviction but said the judge must reconsider the length of the prison term.
The case stems from a 2021 road rage incident in which Gabriel Horcasitas shot and killed Christopher Pelkey. At sentencing, Pelkey's sister Stacey Wales played a video featuring an AI likeness of her brother, scripted with her own words, in which the avatar forgave Horcasitas and said they 'could have been friends' in another life. The judge said 'I loved that video' before handing down the maximum sentence of 10 and a half years.
Wales told 404 Media that influencing the judge was the entire point, and she defended the video as a form of human connection. The appeals court disagreed, determining that the video's emotional impact was undue and required a fresh look at the sentence.
