Both The Verge and Engadget report that US District Judge Zachary Bluestone dismissed Ann Altman's lawsuit against OpenAI CEO Sam Altman on Tuesday. The dismissal was with prejudice, meaning the case cannot be refiled in that court. The judge did not rule on the truth of the allegations; instead, he cited Ann's failure to appear for an independent medical examination and other missed deadlines despite warnings.
Engadget adds that the lawsuit, filed in January 2025, alleged abuse at the family's Missouri home between 1997 and 2006. An earlier version was dismissed because claims had expired, but Ann refiled under a Missouri childhood sexual abuse law. The Verge notes that Bluestone denied Sam Altman's request for attorney fees and costs, while Engadget reports the judge approved Sam's request to withdraw a defamation counterclaim against his sister.
Sam Altman, his mother, and two brothers have denied the allegations as "entirely untrue" in a joint statement. Ann's former lawyer, Santos Perez, who withdrew from the case this month, said he is no longer authorized to comment but continues to believe in her.
